Found a loophole in my landlord's lease renewal clause after 2 years of overpaying

I was re-reading my lease agreement for my apartment in Oakland last week and noticed a clause about rent control caps I'd totally missed. Turns out my landlord was hiking my rent by 8% each year, but California law only allows 5% plus inflation in my area. I showed it to a tenant rights group and they helped me draft a letter to recover about $1,200 in overcharges. Has anyone else caught something sneaky in their lease documents?

Maybe, but that extra 3% isn't exactly life changing money.

Did you check if that 5% cap applies to units built before a certain year? Some buildings constructed after 1995 are exempt from those limits in California.
